The Biden administration is extending its student loan repayment moratorium, which was set to expire at the end of the year, to 2023, while his promise of federal aid remains  in criminal court.

Payments will continue for 60 days after the end of the debt relief program, 60 days after the lawsuit is resolved, or 60 days after June 30 if the lawsuit is unsuccessful.

Since the start of the COVID-19 pandemic in early 2020, borrowers have had to pay more or less on their federal student loans.

The refund has been extended several times since then, and Biden's previous extension on Dec. 31 was  to be the last.

The White House said Tuesday's extension eases uncertainty for borrowers as the administration asks the Supreme Court to review lower court rulings blocking Biden's student loan program.

"I'm sure our student debt plan is legal. But it's on hold because Republican officials want to block it," Biden tweeted.

"Therefore, [Education Secretary Miguel Cardona] extends the payment moratorium no later than [60 days] until June 30, 2023, giving the Supreme Court time to consider the matter during the current term."

In August, Biden announced his plan to facilitate up to $10,000 in federal student loan assistance for low- and moderate-income borrowers — up to $20,000 for eligible Pell Grant recipients — but he quickly ran into opposition from Republicans.

Earlier this month, a federal judge in Texas ruled Biden's program illegal, although the Justice Department appealed the decision.

Additionally, in a separate case, a federal appeals court granted Biden relief injunctions on behalf of six states, arguing that financial institutions would be harmed if borrowers were not required to pay outstanding debts.

The Biden administration asked the Supreme Court to investigate the matter, hoping to pass the program.
